15th State to Opt-Out
California has opted-out of the federal physician supervision requirement for CRNAs, as permitted in the November 13, 2001, Centers for Medicare & Medicaid Services (CMS) rule. California becomes the 15th state to opt out from the federal supervision requirement.
California Governor Arnold Schwarzenegger’s opt-out letter was dated June 10, 2009, and was received, processed and date-stamped at CMS on July 17. The opt-out is effective upon receipt at CMS and is, therefore, effective as of July 17. Governor Schwarzenegger’s letter noted that “[h]aving consulted with the California Board of Medicine and California Board of Registered Nursing and having determined that this exemption is consistent with state law, I have concluded that it is in the interests of the people of California to opt out of this requirement.”
